O recurso ao ADN mediante intervenção no corpo humano e a sua utilização na identificação e prova criminal

Abstract

O presente trabalho de investigação revela o estudo sobre o contributo da aplicação das novas técnicas de análise de ADN na resolução de casos criminais. Contudo, a utilização das potencialidades destes técnicas inovadoras com recurso ao ADN, para fins criminais encerra vários e complexos problemas, aos quais não é possível fechar os olhos. Para a análise de ADN é necessário contar com qualquer tipo de amostra ou produto que contenha material genético, que se encontra em todas as células nucleadas no material submetido a análise, tornando-se a análise de ADN como método padrão para o estudo forense de vestígios biológicos. Sucede que, em algumas situações, para recolher essas amostras é preciso atuar sobre o corpo recetor de tal técnica. Devido a ela – tanto a extração prévia da amostra biológica como a posterior análise ao material genético (ADN) ora recolhido – podem ser limitados certos direitos fundamentais. É inerente a toda investigação criminal que existam restrições a direitos fundamentais, desde que cumpridas determinadas garantias que, de resto, deverão nortear sempre este tipo de diligências probatórias conducentes à descoberta da verdade material, sob pena de a prova assim obtida ser proibida. Com efeito, a análise de ADN, mediante intervenção no corpo de uma pessoa, situa-se neste limite entre a prova permitida e a proibida. Para tanto, almeja-se encontrar um equilíbrio, não diminuindo, por um lado, as garantias de defesa e os direitos fundamentais da pessoa submetida a este tipo de prova e não sacrificando, por outro, os interesses comunitários em nome da verdade material, de prosseguir a tarefa de combate à criminalidade e de repreender, sempre que necessário, os seus responsáveis.

This investigation paper reveals the study about the contribution of the application of the new DNA analysis techniques in the resolution of criminal cases. However, the use of the potentialities of this innovative techniques resorting to DNA, to criminal use bring many complex problems, which you can’t ignore. To analyze DNA it’s necessary to numerate any type of sample of product that contains genetic material, which is found in every nucleated cell of the material subjected to analysis, making the DNA analysis the standard method to the forensic study of biological remains. It happens that, in some situations, to retract this samples it’s necessary to act on the receiving body of that technique. Due to it – may it be the prior extraction of the biological sample or the posterior analysis of the collected genetic material (DNA) – certain fundamental rights can be limited. It’s inherent to every criminal investigation that restrictions to fundamental rights are a reality, as long as certain guarantees are full field, which should always be the cornerstone of this kind of evidentiary diligences leading to the discovery of the material truth. Otherwise, the evidence will be forbidden. The DNA analysis, when it interferes with a person’s body, it’s in the limit between allowed and forbidden evidence. For so, we urge to find a balance, not diminishing the defense guarantees and fundamental rights of the person submitted to this kind of evidence, and not sacrificing as well the community interest to achieve the material truth, to proceed with the task of criminal fight and to reprimand, when necessary, the responsible.
