Abstract

O principal objetivo do estudo da presente investigação é a análise do contrato de prestação de serviços médicos à luz do direito da União Europeia. O tema, por si só implica uma profunda pesquisa, seja em termos legislativos, normativos e literários. A pertinência do estudo está relacionada com a necessidade de identificar os principais pressupostos no que diz respeito à análise da evolução do Direito Privado Europeu, procurando descobrir um sentido para a evolução deste Direito e da necessidade da sua codificação ou não ao nível europeu. O Contrato de prestação de Serviços Médicos, regulado no DCFR e também já objeto de regulação no BGB desde 2013, é considerado por uns como um problema do direito e, por outros, como um enriquecedor e precioso instrumento do Direito da Medicina. Indo ao encontro da primeira das orientações, principalmente no que diz respeito à sua tipificação legal, a presente dissertação, visa analisar o impacto e os principais entraves que decorrem na prática.

The main objective of this research study is to analyze the contract to provide medical services in the light of European Union law. The issue in question in itself implies a deep research, either in legislative, regulatory and literary terms. The relevance of study is related to the need to identify the main assumptions with regard to the analysis of the evolution of European Private Law, trying to discover a sense for the evolution of this law and the need for its codification or not at European level. The contract of Medical Services, under the regulations of DCFR is also sharing ordinance with BGB since 2013. Is seen by many as an issue/obstacle, on the other hand, many others see it with different eyes. As a powerful and valuable resource applicable to the Medical Law. According to the first set of orientations given, the present Dissertation battles to analyze the impact and the main barrier that results from the practice, with relevance to its legal classification.
