Violência doméstica e Justiça Restaurativa: uma análise após a Convenção de Istambul

Abstract

A violência doméstica, mais especificamente a violência conjugal, contra a mulher, embora seja uma prática antiga, ainda permanece em nossa sociedade, mesmo após anos de luta pela igualdade de género. Diante das respostas oferecidas pelo sistema jurídico tradicional constatamos que este ainda se manifesta de forma ineficaz, sendo necessário a criação de meios alternativos de solução de conflitos. Diante deste cenário este trabalho se dedica a apresentar a Justiça Restaurativa como mecanismo eficaz de resolução de conflitos, tendo em vista sua preocupação em dar voz à vítima, proporcionando através de encontros, quer seja apenas entre vítima e agressor, quer seja com a ajuda de demais agentes, que o dano seja reparado e o conflito seja sanado. Tomando por base a Convenção de Istambul e as alterações legislativas que a mesma proporcionou na União Europeia traçamos um paralelo entre os países que fazem uso da Justiça Restaurativa e em especial abordamos a Legislação Portuguesa que revogou o encontro restaurativo como mecanismo de resolução dessa espécie de conflitos.

Domestic violence, more specifically conjugal violence, against women, although it is an old practice, still remains in our society, even after years of struggle for gender equality. In view of the responses offered by the traditional legal system, we found that it still manifests itself ineffectively, requiring the creation of alternative means of resolving conflicts. In view of this scenario, this work is dedicated to presenting Restorative Justice as an effective conflict resolution mechanism, in view of its concern in giving the victim a voice, providing through meetings, whether only between victim and aggressor, or with the help of other agents, that the damage is repaired and the conflict is resolved. Based on the Istanbul Convention and the legislative changes that it brought about in the European Union, we draw a parallel between the countries that use Restorative Justice and, in particular, we approach the Portuguese Legislation that revoked the restorative meeting as a mechanism to resolve this type of conflicts.
