Resumo(s): | A procriação medicamente assistida tem evoluído a uma velocidade alucinante. Os avanços
médicos, tecnológicos e científicos possibilitaram essa evolução, todavia, o Direito ficou aquém destes
progressos e não logrou acompanhá-los, ainda que o recurso a estas técnicas seja cada vez mais
frequente. Assim, a presente dissertação debruça-se sobre os vários aspetos da procriação medicamente
assistida, em especial sobre a técnica mais controversa: a procriação medicamente assistida homóloga
post mortem e os seus efeitos no âmbito do Direito das Sucessões.
A legislação portuguesa possui graves lacunas no âmbito deste tema, nomeadamente no que
respeita aos direitos sucessórios atribuídos aos gâmetas e embriões criopreservados. Acresce que a lei
não estabelece qualquer prazo para a reprodução post mortem, sendo certo que admite a transferência
embrionária e proíbe a inseminação artificial e a fertilização in vitro. Por sua vez, o diploma legal não
determina qualquer sanção penal para a violação das técnicas que proíbe; no entanto, garante o
estabelecimento da filiação em relação ao falecido pai. Assim sendo, se juridicamente a criança nascida
através da procriação medicamente assistida homóloga post mortem é considerada filha do autor da
sucessão, também ela fará parte dos sucessíveis e terá direitos hereditários sobre a herança por ele
deixada.
Deste modo, e perante a falta de regulação legislativa, é estritamente necessário atualizar a lei
e incluir, de uma forma mais clara e precisa, os concepturos e os nascituros nas quotas hereditárias do
de cujus, pelo menos de uma forma mais equitativa. Enquanto eventuais e futuros seres humanos,
possuem dignidade e, enquanto eventuais e futuros filhos do autor da sucessão, merecem o respeito e
igualdade que a lei permite e atribui aos herdeiros já nascidos.
O Direito deve evoluir simultaneamente com a Ciência e a Medicina, pelo que corrigir a omissão
legislativa, no sentido de aplicar prazos para a prática técnicas de procriação medicamente assistida
homóloga post mortem, bem como especificar concretamente quais os direitos sucessórios dos
nascituros e dos concepturos e, simultaneamente, estabelecer um regime para a partilha da herança;
ou, por outro lado, vedar especificamente determinadas técnicas e aplicar sanções penais para a sua
violação, não atribuindo quaisquer direitos sucessórios (ou até filiatórios) em relação à criança que nasça
derivada daquelas técnicas, é essencial. Medically assisted procreation has evolved at an impressive speed. Medical, technological and scientific advances made this evolution possible, however, Law fell short of this progress and failed to keep up with it, even though these procedures are much more frequent. Thereby, this dissertation focuses on several aspects of medically assisted procreation, especially on the most controversial technique: postmortem homologous medically assisted procreation and its effects within the scope of Succession Law. Portuguese legislation has serious gaps in this area, namely in what regards to inheritance rights given to cryopreserved gametes and embryos. Furthermore, the law does not establish any time limit for postmortem reproduction, although it admits embryo transfer and prohibits artificial insemination and in vitro fertilization. Also, the legal diploma does not define any penal sanction for the violation of the techniques it forbids; however, it guarantees the establishment of paternity in relation to the deceased father. Therefore, if legally the child born through postmortem homologous medically assisted procreation is considered to be the daughter of the successor, she will too be part of the successors and will have hereditary rights over the inheritance left by him. As so, and given the lack of legislative regulation, it is strictly necessary to update the law and include, in a more clear and precise way, unconceived and unborn children in the hereditary shares of the de cujus, at least in a more equitable way. As eventual and future human beings they are entitled to dignity and, as eventual and future children of the successor, they deserve the respect and the equality that Law allows and gives to the already born heirs. Law must evolve simultaneously with Science and Medicine, therefore correcting the legislative omission, towards applying deadlines for the practice of postmortem homologous medically assisted procreation, as well as expressly specifying the inheritance rights of the unborn and the unconceived child and, simultaneously, establishing a system for the heritage sharing; or, on the other hand, specifically forbidding certain techniques and applying criminal sanctions for their violation, as well as not assigning any inheritance (or even paternity) rights towards the child born from those techniques, it is essential. |
