Constitucionalismo, igualdade e não discriminação entre homens e mulheres na União Europeia e no Brasil

Abstract

A presente investigação científica tem por escopo estudar o Constitucionalismo, tendo em conta a sua evolução constitucional e teorias interpretativas, seja por via da interconstitucionalidade na União Europeia, seja por via do neoconstitucionalismo e garantismo no Brasil, mediante análise de seus contributos para sustentação e realização do direito de igualdade entre homens e mulheres. A pesquisa apresenta-se em três capítulos, sendo que o primeiro trata da constitucionalização dos tratados e da concomitante evolução da teoria da interconstitucionalidade, e que muito pela atuação do TJUE, apresenta uma nova teoria hermenêutica, a qual é analisada, neste campo, com o propósito de identificar em que passo se constitui mecanismo de promoção dos princípios democrático, de respeito aos direitos humanos e de igualdade, intrinsicamente relacionados com o desenvolvimento do princípio e direito de igualdade entre homens e mulheres. O segundo capítulo aborda os caminhos percorridos pelo Constitucionalismo no Brasil no contexto das conquistas democráticas relacionadas à participação feminina na Constituinte de 1987-1988. A investigação perpassa, ainda, frente à necessária efetivação do direito fundamental de igualdade entre homens e mulheres, pelos debates acerca da exegese e achamento do método de interpretação da Constituição Federal de 1988, inclusive no que se refere a atuação do STF, tomando-se o neoconstitucionalismo e o garantismo como alternativas hermenêuticas. A abordagem dos primeiro e segundo capítulos sobre o Constitucionalismo e as teorias interpretativas da Constituição (na União Europeia alusiva aos tratados constitutivos), operadas pelos TJUE e STF, tem por intuito identificar em que medida são elas propulsoras da igualdade entre homens e mulheres. Por fim, como a teoria da interconstitucionalidade também se preocupa com a intergovernabilidade, traduzindo-se inclusive em uma teoria de interculturalidade constitucional, o terceiro capítulo apresenta as importantes iniciativas políticas e legislativas da União Europeia em sede de igualdade de oportunidades e não discriminação entre homens e mulheres. Dentre elas, destaque é dado para a Diretiva (UE) 2019/11581158 – Diretiva Equilíbrio Trabalho-Vida, relativa ao equacionamento e partilha das responsabilidades familiares, a qual se constitui, conforme estudo, boas práticas passíveis de serem adotadas pelo Brasil, no enfrentamento das assimetrias causadas pelas desigualdades entre homens e mulheres nos espaços laborativos.

This scientific research aims to study Constitutionalism, taking into account its constitutional evolution and interpretive theories, whether through interconstitutionality in the European Union or through neoconstitutionalism and guaranteeism in Brazil, through an analysis of its contributions to the materialization of the right to equality between men and women. This research is presented in three chapters, the first deals with the constitutionalization of treaties and the concomitant evolution of the theory of interconstitutionality. Due to the role of the Court of Justice of the European Union (CJEU), a new hermeneutic theory is presented and analyzed in this field, in order to identify the stage at which the mechanism for the promotion of the principles of democracy, respect for human rights, and equality was constituted, these being intrinsically related to the development of the principle and right of equality between men and women. The second chapter addresses the paths taken by Constitutionalism in Brazil in the context of the democratic achievements related to female participation in the 1987-1988 Constituent Assembly. Given the necessary realization of the fundamental right of equality between men and women, the investigation also includes the debates on the exegesis and discovery of the method of interpretation of the Federal Constitution of 1988, including with regard to the performance of the Brazilian Supreme Federal Court (STF), taking “neoconstitutionalism” and “guarantism” as hermeneutic alternatives. The approach of the first and second chapters on Constitutionalism and the interpretative theories of Constitution (in the European Union alluding to the constitutive treaties), operated by the CJEU and the STF, aims to identify the extent to which they are drivers of equality between men and women. Finally, as the theory of interconstitutionality is also concerned with intergovernability, including translating itself into a theory of constitutional interculturality, the third chapter presents the important political and legislative initiatives of the European Union towards equal opportunities and non-discrimination between men and women. Among them, emphasis is given to Directive (EU) 2019/11581158 - Work-Life Balance Directive, which relates to equal participation and sharing of family responsibilities and which constitutes, according to the study, a set of good practices that can be adopted by Brazil to deal with the inequalities between men and women in the workplace.
