O notário e a atividade notarial: certeza e segurança jurídica

Abstract

A presente dissertação de mestrado, conforme o próprio título denuncia, aborda o notário e a atividade notarial, procurando explicitar de que modo é que o notário realiza a certeza e a segurança jurídica, a fim de obtê-las como resultados da atividade notarial que desempenha. A certeza e a segurança jurídica consistem em duas das grandes finalidades do direito com contornos distintos, mas o nosso propósito é aplicar estes dois conceitos ao notariado, uma vez que ambas se encontram na essência da atividade notarial, fazendo parte da missão do notário. Assim, certeza e segurança jurídica serão vistas como dois efeitos da atividade notarial. O estudo sobre uma aplicabilidade destas duas noções nunca foi feito no nosso ordenamento jurídico. Pretendemos que fique claro ao leitor, que o modelo de notário e atividade notarial que seguiremos é a latina, dado que é esta que se integra no nosso sistema notarial latino. A análise iniciar-se-á com a função notarial, com saliência no notário latino e exame na principiologia que rege a nossa atividade notarial. Nesta fase, ficarão delineadas as noções de certeza e de segurança jurídica com uma aplicação restrita ao notariado, que serão as chaves mestras. Seguir-se-á o enfoque na atividade notarial no que respeita ao controlo da legalidade efetuado pelo notário, pautado pela concretização intransigente de certeza e segurança jurídica e os principais atos notariais, com uma incidência especial na escritura pública, enquanto ato notarial paradigma com indícios de realização elevada daqueles dois valores. Mais tarde, serão abordados conceitos como a desformalização e a simplificação e de seguida, as novas tendências da atividade notarial na era digital, em que se procurará refletir sobre a execução de certeza e de segurança jurídica, num quadro de simplificação dos atos notariais. Por fim, o nosso intuito é o de contribuirmos positivamente para o desenvolvimento da doutrina nacional na área do notariado, com vista ao seu estudo e auxílio na prática notarial.

This master's thesis, as its title denounces, addresses the notary and the notarial activity, seeking to explain how the notary achieves legal certainty and security in order to obtain them as a result of the notarial activity that he performs. Certainty and legal certainty consist of two of the great purposes of law with different contours, but our purpose is to apply these two concepts to the notary since both are at the essence of the notarial activity, being part of the notary's mission. Thus, certainty and legal certainty will be seen as two effects of the notarial activity. The study on the applicability of these two notions has never been done in our legal system. We intend to make it clear to the reader that the model of the notary and notarial activity that we will follow is the Latin one, given that this is part of our Latin notarial system. The analysis will begin with the notarial function, emphasising the Latin notary and examination of the principle that governs our notarial activity. At this stage, the notions of certainty and legal security were outlined, with a restricted application to the notary, which will be the master keys. The focus on notarial activity will follow concerning the control of legality carried out by the notary, guided by the strict implementation of certainty and legal certainty and the main notarial acts, with a particular focus on the public deed, as a notarial act with evidence of high achievement of those two values. Later, concepts such as deformalization and simplification will be discussed, followed by new trends in notarial activity in the digital age. Subsequently, we will seek to reflect on the execution of certainty and legal certainty within a framework of simplification of notarial acts. Finally, we aim to positively contribute to the development of national doctrine in the notary's area, with a view to its study and assistance in notarial practice.
