O contrato de gestação de substituição e o princípio da dignidade da pessoa humana

Abstract

A presente dissertação enseja analisar de maneira mais aprofundada da gestação de substituição à luz da dignidade da pessoa humana. Trata-se de uma temática extremamente delicada, envolta de grandes controversas e debates, cuja abordagem é imprescindível. Se faz necessário sua contextualização no ordenamento jurídico, desenvolvendo os aspetos concernentes ao contrato gestacional, buscando verificar se as garantias impostas pelo legislador se mostraram suficientes à proteção da dignidade humana. Da mesma forma, é imprescindível examinar o essencial acórdão do Tribunal Constitucional, que deixou em suspenso os contratos de gestação em Portugal, demonstrando expetativas futuras para a compatibilização do regime como o acórdão. Cuida, por fim, elaborar uma análise específica voltada à dignidade da gestante de substituição e da criança do contrato gestacional, de modo a ponderar possíveis impactos e a devida proteção aos envolvidos. O principal objetivo da pressente investigação direciona-se na análise da gestação de substituição e a sua compatibilização com a dignidade da pessoa humana, princípio norteador da procriação medicamente assistida. Pretende assim o presente trabalho, demonstrar a importância da regulação dos contratos gestacionais, em termos que salvaguardem a dignidade e os direitos dos envolvidos, especialmente dos mais vulneráveis.

The present dissertation aims to analyze more deeply the surrogacy in the light of human dignity. It is an extremely delicate theme, surrounded by great controversy and debate, whose approach is essential. It is necessary to contextualize it in the legal system, developing the aspects concerning the gestational contract, trying to verify if the guarantees imposed by the legislator were sufficient to protect human dignity. Likewise, it is essential to examine the essential ruling of the Constitutional Court, which left gestational contracts suspended in Portugal, demonstrating future expectations for the compatibility of the regime with the ruling. Finally, it is important to elaborate a specific analysis focused on the dignity of the surrogate mother and the child of the gestational contract, in order to ponder possible impacts and the due protection to those involved. The main objective of the present investigation is directed to the analysis of surrogacy and its compatibility with human dignity, the guiding principle of medically assisted procreation. Thus, the present work intends to demonstrate the importance of regulating gestational contracts in terms that safeguard the dignity and rights of those involved, especially the most vulnerable.
