Governação pública digital local e sanções administrativas

Abstract

Num contexto de acelerada transformação digital, o presente artigo pre‑ tende refletir sobre as coimas até então aplicadas a autarquias locais portuguesas, por violação dos pertinentes princípios e regras previstos no Regulamento Geral sobre a Proteção de Dados e na Lei n.º 58/2019, de 8 de agosto: (i) a montante, pro‑ curando explicar o que falhou para que tais sanções administrativas tivessem ocor‑ rido; (ii) a jusante, projetando parte do que poderá ser feito por Municípios e Fre‑ guesias para que estas não se voltem a repetir.

In a context of digital switchover, the present article aims to reflect on the fines so far imposed to Portuguese local authorities, for the infringement of theGeneral Data Protection Regulation and the Law No. 58/2019, of 8th August: (i) on the one hand, explaining what failed, for those administrative sanctions to have happened; (ii) on the other hand, anticipating part of what can be done, so as to prevent them from happening again.
