O crime de violação da obrigação de alimentos

Abstract

A presente dissertação visa analisar a conduta de incumprimento da obrigação de prestação de alimentos devido a filhos menores suscetível de configurar a prática do crime de violação da obrigação de alimentos previsto no artigo 250.º do Código Penal. Inicialmente faremos um enquadramento jurídico-civil que vai auxiliar na compreensão do que está subjacente à obrigação daquela prestação, bem assim a tutela civil tendente à efetivação do direito a alimentos e os pressupostos de que depende a intervenção do Fundo de Garantia de Alimentos Devidos a Menores. Num momento subsequente, iremos expor e analisar as principais controvérsias que norteiam o ilícito penal, enfatizando a divergência doutrinária e jurisprudencial a respeito do bem jurídico protegido pela incriminação prevista no artigo 250.º do Código Penal, demostrando que do ponto de vista prático se manifesta de grande relevância.

This dissertation aims to analyze the conduct of non-compliance with the obligation to provide maintenance (or alimony) due to minor children, susceptible of constituting the practice of the crime of violation of the maintenance obligation provided for in article 250 of the Penal Code. Initially, we will make a civil-legal framework that will help in understanding what underlies the obligation of that provision, as well as the civil protection tending to the realization of the right to alimony and the assumptions on which the intervention of the Guarantee Fund for Alimony Due to Minors depends. In a subsequent moment, we will expose and analyze the main controversies that guide the criminal offense, emphasizing the doctrinal and jurisprudential divergence regarding the legal interest protected by the incrimination provided for in article 250.º of the Penal Code, demonstrating that the practical point of view manifests itself of great relevance.
