| dc.description.abstract | A Inteligência Artificial está a evoluir constantemente e encontra-se cada vez mais presente no nosso dia-a-dia, veja-se o uso de eletrodomésticos inteligentes, os próprios assistentes do nosso telemóvel, os veículos autónomos, os robots juízes que auxiliam na tomada de decisões, as aplicações de encontros, ou até o chat GPT ou o Bard. A Inteligência Artificial veio para ficar e embora apresente diversos benefícios, como é visível, desde logo, na área da saúde, pela capacidade de aperfeiçoamento dos diagnósticos, a verdade é que também acarreta diversos riscos, desde logo, pela imprevisibilidade no seu comportamento, uma vez que os agentes autónomos conseguem tomar atitudes de forma autónoma e aprender com o meio em que se encontram. Deste modo, o objetivo principal desta dissertação é responder à seguinte questão: “Que caminho deve ser seguido no âmbito da responsabilidade por danos causados pela IA?”. Assim, de modo a responder a esta questão, começaremos por (1) esclarecer o conceito de Inteligência Artificial, além disso (2) será feito um breve contexto do tratamento que lhe é atribuído pelos ordenamentos jurídicos internacionais. Também (3) será apresentado um conjunto de dificuldades que a Inteligência Artificial apresenta no âmbito da responsabilidade civil, partindo-se deste ponto, (4) para expor a problemática da personalidade jurídica. De seguida iremos apresentar as soluções para a questão a que esta dissertação se propõe responder, neste sentido, (5) começaremos pela tentativa de adaptação do regime existente, (6) expondo a questão da indemnização pelos danos causados pelos sistemas de Inteligência Artificial, (6) bem como pela possibilidade de aplicação de propostas alternativas. | dc.description.abstract | Artificial Intelligence is constantly evolving and is increasingly becoming a part of our daily lives, for example the use of smart household appliances, our own cell phone assistants, autonomous vehicles, robot judges who help with decision-making, dating apps, or even ChatGPT or Bard. Artificial Intelligence is here to stay and although it has several benefits, such as the ability to improve diagnoses in health, it also carries several risks, first and foremost due to the unpredictability of its behavior, since it can act autonomously and learn from its environment. Therefore, the main goal of this dissertation is to answer the following question: "What path should be followed in the area of liability for damage caused by AI?". So, to answer this question, we will begin by (1) clarifying the concept of Artificial Intelligence and (2) giving a brief context of how other legal systems are dealing with Artificial Intelligence. We will also (3) present a set of difficulties that Artificial Intelligence presents in the context of civil liability, and from this point we will (4) expose the problem of legal personality in the context of Artificial Intelligence. Next, we will present the solutions to the question that this dissertation proposes to answer, in this sense, (5) we will begin by attempting to adapt the existing regime, (6) exposing the issue of compensation for damages caused by Artificial Intelligence systems, (6) as well as the possibility of applying alternative proposals.
