| dc.description.abstract | O presente trabalho tem como principal objetivo estudar a necessidade e viabilidade da adoção de um regime de Colaboração Premiada em Portugal. A dificuldade investigatória e a complexidade das organizações em causa tornam a positivação deste regime indispensável. A temática do direito premial não é uma novidade na nossa legislação. De facto, é possível encontrar pequenos vestígios deste regime no nosso Código Penal, bem como em legislação avulsa. No entanto, afigura-se crucial o desenvolvimento de um regime uniforme de colaboração entre o arguido e a justiça, de forma a assegurar que este mecanismo é aplicado de forma justa e devidamente controlada, evitando práticas abusivas e promovendo a segurança jurídica. Embora o regime de Colaboração Premiada levante algumas controvérsias relativamente à sua compatibilidade legal e social com o nosso ordenamento jurídico, o presente estudo visa demonstrar que, pelo contrário, a colaboração do arguido na fase investigatória e a consequente atribuição de um benefício penal na fase de julgamento mostram-se compatíveis com o atual panorama legal português. Para um desenvolvimento bem-sucedido deste regime, revela-se importante a realização de um estudo prévio das soluções adotadas noutros ordenamentos jurídicos, bem como a sua compatibilidade com os princípios estruturantes do direito penal e o valor legal das declarações do arguido colaborador. De igual forma, mostra-se também relevante a análise dos mecanismos de diversão existentes, assim como das disposições de direito premial já positivadas no nosso ordenamento jurídico. Neste sentido, o trabalho realizado compreende uma análise analítica e crítica das temáticas anteriormente apresentadas, debruçando-se sobre os pontos positivos e negativos da implementação de um regime de Colaboração Premiada em Portugal, com o objetivo de desenvolver uma solução eficaz e adequada à realidade jurídica nacional. | por |
| dc.description.abstract | The primary objective of this work is to study the need and feasibility of adopting a Plea- Bargaining regime in Portugal. The investigative challenges and the complexity of the organizations involved make the establishment of this regime essential. The concept of rewarding cooperation in criminal law is not entirely new in our legislation. In fact, small traces of this regime can be found in our penal code, as well as in scattered legislation. However, it is crucial to develop a uniform system of collaboration between the defendant and the justice system to ensure that this mechanism is applied fairly and appropriately regulated, preventing abusive practices and promoting legal certainty. Although the Plea-Bargaining regime raises certain controversies regarding its legal and social compatibility with our legal system, the present study aims to demonstrate that, on the contrary, the cooperation of the defendant during the investigative phase and the consequent granting of a penal benefit at the sentencing stage are compatible with the current Portuguese legal framework. For a successful development of this regime, it is essential to conduct a preliminary study of solutions adopted in other legal systems, as well as to assess their compatibility with the fundamental principles of criminal law and the legal value of the statements made by the cooperating defendant. Similarly, it is also relevant to analyze existing diversion mechanisms, and any provisions of rewarding cooperation already established in our legal system. In this regard, this work provides an analytical and critical examination of the topics mentioned above, focusing on the pros and cons of implementing a Plea-Bargaining regime in Portugal, with the aim of developing an effective solution tailored to the national legal reality. | por |
