dc.description.abstractEsta investigação empreende uma análise do teletrabalho, desde a sua génese histórica até à atualidade, com particular destaque para as influências significativas resultantes da pandemia COVID-19. Este estudo abrangente não só desvela as substanciais transformações nesse novo paradigma de trabalho, como também explora a emergência e consolidação do direito à desconexão laboral, proporcionando uma visão completa e perspicaz deste tema complexo e de indiscutível relevância. Assim, no primeiro capítulo, teremos a oportunidade de examinar o enquadramento terminológico e conceptual do Direito do Trabalho, assim como a sua evolução histórica, de forma breve e como ponto de partida para a compreensão do tema. No segundo capítulo abordaremos o regime do Teletrabalho, mais precisamente, a sua origem, as modalidades e a sua consequente evolução e forneceremos uma análise da aplicação e regulamentação do Teletrabalho antes, durante e após a inexorável pandemia da COVID-19. Já no terceiro capítulo, destacaremos de modo proeminente as vantagens intrínsecas ao teletrabalho, englobando as valias de natureza financeira e temporal, a potenciação do desempenho e produtividade, a promoção da autonomia e alavancagem da motivação profissional, bem como a inclusão socioprofissional de indivíduos com necessidades especiais. Em igual medida, não se relegarão às sombras as desvantagens inerentes, a saber, o isolamento social, os desafios de supervisão remota das equipas e as subtilezas na delimitação entre a esfera profissional e a pessoal, concebendo assim um cenário preambular para a abordagem subsequente. No último capítulo, um foco meticuloso será direcionado ao direito à desconexão. Este será enquadrado no tempo de trabalho, abarcando o período laboral e os momentos de repouso. Neste contexto, uma reflexão aprofundada sobre a pertinência e alcance da legislação deste direito no enquadramento jurídico português será empreendida. Além disso, será escrutinada a configuração deste direito em outros países. Em paralelo, serão expostas e analisadas as consequências práticas decorrentes de uma conexão laboral ininterrupta, incluindo a ponderação da viabilidade de encarar o desrespeito do direito ao descanso por parte do empregador como uma manifestação de assédio laboral.por
dc.description.abstractThis research undertakes an analysis of telecommuting, from its historical origins to the present day, with particular emphasis on the significant influences resulting from the COVID-19 pandemic. This comprehensive study not only unveils the substantial transformations in this new work paradigm but also explores the emergence and consolidation of the right to disconnect from work, providing a complete and insightful view of this complex and undoubtedly relevant topic. In the first chapter, we will have the opportunity to examine the terminological and conceptual framework of Labor Law, as well as its historical evolution, briefly as a starting point for understanding the subject. In the second chapter, we will address the Telecommuting regime, more precisely, its origin, modalities, and its subsequent evolution, providing an analysis of the application and regulation of Telecommuting before, during, and after the inexorable COVID-19 pandemic. In the third chapter, we will prominently highlight the inherent advantages of telecommuting, including financial and time-related benefits, enhanced performance and productivity, the promotion of autonomy, and boosting professional motivation, as well as the socio professional inclusion of individuals with special needs. Equally, the inherent disadvantages will not be ignored, namely social isolation, the challenges of remote team supervision, and the subtleties in delineating between the professional and personal spheres, thus creating a preliminary scenario for subsequent discussion. In the final chapter, meticulous attention will be directed toward the right to disconnect. This will be framed within working hours, encompassing the working period and moments of rest. In this context, an in-depth reflection on the relevance and scope of legislation related to this right in the Portuguese legal framework will be undertaken. Additionally, the configuration of this right in other countries will be examined and analyzed. In parallel, the practical consequences of uninterrupted work-related connections will be exposed and analyzed, including the consideration of the employer's disregard for the right to rest as a manifestation of workplace harassment.por
