A solidariedade no ordenamento jurídico da União Europeia: uma releitura do princípio aplicado ao ambiente e às migrações

Abstract

O presente trabalho teve por escopo desenvolver a ideia de que o princípio da solidariedade pode ser compreendido como um novo paradigma interpretativo do direito. Para tanto, discorremos sobre o desenvolvimento do paradigma mecanicista e individualista firmado a partir do Renascimento, trazendo a lume um apanhado sobre jusnaturalismo, positivismo, pós-positivismo, Estado Liberal, Estado do Bem-Estar Social e Neolibreralismo para chegar à conclusão de que o atual contexto de globalização, desigualdades sociais, revolução digital, etnocentrismo, reacionarismo anti-democrático, mudanças climáticas e tensão migratória decorre exatamente do fato de a civilização atual ter atingido um ponto de mutação em que a viragem de paradigma é essencial para a sua continuidade. Propomos que a solidariedade seja esse novo paradigma, discorrendo sobre seus significados e a sua posição na teoria de Jurgen Habermas, como outra face da justiça e fruto da moral comunitária, delineando a importância da comunidade nesse processo, visto que caberá a ela reassumir a sua soberania sobre o direito por meio do agir comunicativo, reestabelecendo o equilíbrio entre Estado, mercado e setor plural, transformando a solidariedade em uma nova energia utópica da sociedade. Entendido esse papel da comunidade, analisamos a teoria da integridade de valor de Ronald M. Dworkin, um método sistêmico, e não mecanicista, de interpretação jurídica, para então inserir a solidariedade na sua teoria política, ao lado do valor da igualdade. Por fim, considerando que a solidariedade é um valor e um objetivo da União Europeia, submetemos o Pacto Ecológico Europeu (PEE) e o Novo Pacto em matéria de migrações e asilo (Novo Pacto Migratório) ao teste dos sistemas de Dworkin e Habermas, para concluir que enquanto o PEE cumpre os requisitos de liberdade, dignidade, igualdade e solidariedade, o Novo Pacto Migratório não o faz, deixando de atender a dimensão moral na relação entre Estados Membros.

This paper aims to develop the idea that the principle of solidarity can be understood as a new interpretive paradigm of law. To this end, we have discussed the development of the mechanistic and individualistic paradigm established since the Renaissance, bringing to light an overview of jusnaturalism, positivism, post-positivism, the Liberal State, the Welfare State, and Neoliberalism to reach the conclusion that the current context of globalization, social inequalities, digital revolution, ethnocentrism, non-democracy reactionarism, climate change, and migratory tension stems precisely from the fact that the current civilization has reached a mutation point where a paradigm shift is essential for its continuity. We propose that solidarity is this new paradigm, discussing its meanings and its position in Jurgen Habermas' theory, as another face of justice and the outcome of community morality, outlining the importance of the community in this process, since it will be up to it to reassume its sovereignty over the law through communicative action, reestablishing the balance between state, market, and plural sector, transforming solidarity into a new utopian energy of society. Understanding this role of the community, we analyze Ronald M. Dworkin's theory of value integrity, a systemic, rather than mechanistic, method of legal interpretation, to then insert solidarity in his political theory, alongside the value of equality. Finally, considering that solidarity is a value and a goal of the European Union, we submit the European Green Deal (EEP) and the New Pact on Migration and Asylum (New Migration Pact) to Dworkin's and Habermas' systemic test, to conclude that while the EEP meets the requirements of freedom, dignity, equality, and solidarity, the New Migration Pact does not, failing to address the moral dimension in the relationship between member states.
